PUBLIC NOTICE is hereby given to all persons that a PUBLIC HEARING will be held on Tuesday, October 21, 2008 at 7:00 PM in the Circuit Courtroom of the Sawyer County Courthouse before the Sawyer County Board of Appeals relative to the following proposals:

VARIANCE APPLICATIONS

 

1)                  Town of Hayward – William P. Kaye etux. Unit #1, Grand Pines Condominium; S 36, T 41N, R 8W; Parcel -36.1.  0.18 acres (7,898 sq/ft).  Property is zoned Residential/Recreational One. Application is for the construction of an 8’ x 24’ addition with basement (for a tornado shelter) onto an existing 20’ x 24’ detached garage, together with a 28’ x 28’ 2nd story addition above the entire building. The garage is now located 63’ to the centerline of County highway B and 48’ to the ordinary high water mark of Little Round Lake. With the proposed addition, the garage will be located 42’ to the ordinary high water mark of the lake.  Variance is requested as Section 4.421(3), Sawyer County Zoning Ordinance, would require that this garage is limited to only ordinary maintenance and repair and the replacement of foundation and roof support systems.

 

2)                  Town of Hayward – Larry A. Hurst etux. Unit #1, Paulson’s Golden Gate Condominium; S 23, T 41N, R 8W; Parcel -17.1.  Volume 488 Records page 374.  0.32 acres. Property is zoned Residential/Recreational One. Application is for the construction of an approximately 20’ x 28’ addition containing 506 square feet onto an existing dwelling at a setback distance of 36’ to the ordinary high water mark of Round Lake and 24’ to the centerline of an easement road. The dwelling is located approximately  23’ to the ordinary high water mark of the lake. Variance is requested as Section 4.21(2)(a), Sawyer County Zoning Ordinance, would require the prior granting of a variance for any expansion of the dwelling as it is located less than 40’ to the ordinary high water mark of the lake and Section 4.21(6), would require a minimum setback distance of 3j0’ to the centerline of the private access easement.

 

3)                  Town of Lenroot – James M. Henk etux.  Lot 3, being part of the NW 1/4 NW        1/4 S 34, T 42N, R 9W; Parcel 2205. Doc# 348654.  0.97 acres total. Property             is zoned Residential/Recreational One. Application is for the construction of                      a 30’ x 40’ (34’ x 44” with eaves) detached garage with loft area at a setback            distance of 10’ to a rear lot line. Variance is requested as Section 18.4(a),                     Sawyer County Zoning Ordinance, would require a minimum setback                              distance of 40’ to this lot line.

 

4)                  Town of Lenroot – Jeffrey  A. Brauer etux. Part of the NE 1/4 NE 1/4, S 33, T 42N, R 9W; Parcel 1.2.  Document #355715. 0.71 acres. Property is zoned Residential/Recreational One. Application is for the construction of a new dwelling (2-story with loft) at a setback distance of 53’ to the centerline of Four Seasons Road (a Town road) and 20’ to a wetland area. Variance is requested as Section 4.49(1), Sawyer County Zoning Ordinance, would require a minimum setback distance of 40’ to the wetland area and Section 4.21(3) would require a minimum setback distance of 63’ to the centerline of the Town road.

 

5)                  Town of Radisson – James A. Doke etux.  Part of Gov’t lot 3, S8, T 39N, R 7W; Parcel :3.6.  Volume 551 Records page 56. 0.40 acres total. Property is zoned Residential/Recreational One. Application is for the construction of an approximately 30’ x 66’ replacement dwelling including eaves with an attached 24’ x 28’ garage and a 12’ x 26’ deck all at 72’ from the ordinary high water mark of BlueberryLake. 5’/24’ from the side lot lines and 45’ to the centerline of Blueberry Avenue, a Town road. The dwelling being replaced is located 26’ to the ordinary high water mark of the lake.  Variance is requested as Section 4.21(3), Sawyer County Zoning Ordinance, would require that the dwelling be located no closer than 63’ to the centerline of the road; Section 4.29(1) would require a minimum setback distance of 75’ to the ordinary high water mark of the lake and Section 18.4(a) would require a minimum setback distance of 10’ and 30’ to the side lot lines.

 

6)                  Town of SandLake – Scott G. Ebert etux. Lot 3 being part of Gov’t lot 14, S5, T 38N, R 9W; Parcel :14.17.  Doc#354833; CSM Volume 10 page 98.  0.78 acres total. Property is zoned Residential/Recreational One. Application is for the construction of a 20’ x 36’ addition onto the landward side of an existing dwelling and the 6’ x 10’ expansion of an existing nonconforming deck for the purpose of connecting the existing deck to the proposed addition. The dwelling is located approximately 28’ to the ordinary high water mark of SissabagamaLake.  Variance is requested as Section 4.21(2)(a), Sawyer county Zoning Ordinance, would require prior granting of a variance for any expansion of this dwelling as the dwelling is located less than 40’ to the ordinary high water mark of the lake and Section 4.21(7) does not allow for the expansion of a nonconforming deck.

 

7)                  Town of Winter – Steven B. King etux. Part of Gov’t lot 2, S 3, T 39N, R 5W; Parcel :2.7.  Volume 612 Records page 394.  0.60 acres total. Property is zoned Residential One. Application is for the construction of an approximately 24’ x 54’ replacement dwelling at a setback distance of 19’ to a non-navigable wetland area. This dwelling will replace an existing dwelling located 27’ to the ordinary high water mark of BarberLake. Variance is requested as Section 4.49(1), Sawyer County Zoning Ordinance, would require a minimum setback distance of 40’ to this wetland area.

 

 

 

PROPOSED AMENDMENT TO SECTION 7.11 OF THE SAWYERCOUNTY BOARD OF APPEALS RULES AND BY-LAWS

 

Reads:

9.11 Action in Circuit Court

Any person or persons jointly or severally aggrieved by any decision of the Board of Appeals, or any taxpayer, or any officer, department, board, or bureau of the County may commence an action in the circuit court for writ of certiorari to review the legality of such decision in whole or in part, within thirty (30) days after the filing of the decision in the office of the Board.

 

Change to read:

9.11 Action in Circuit Court

Any person or persons jointly or severally aggrieved by any decision of the Board of Appeals, or any taxpayer, or any officer, department, board, or bureau of the County may commence an action in the circuit court for writ of certiorari to review the legality of such decision in whole or in part, within thirty (30) days of the date following the date of the signing of the Board’s decision letter. The date following the date of the signing of the Board’s decision letter is the first day of the thirty (30) day appeal filing period.
