Motion by Bassett, 2nd by Kinsley, to approve the meeting agenda as presented.  Motion carried.

 

Motion by Kinsley, 2nd by Zietlow, to approve the February 19, 2009 County Board meeting minutes.  Motion carried.

 

Zoning Department Administrator William Christman presented the Zoning Committee recommendation to approve the following proposed amendment to the Sawyer County Private Sewage System Ordinance:

 

PROPOSED AMENDMENT TO THE SAWYER COUNTY PRIVATE SEWAGE SYSTEM ORDINANCE

 

The Sawyer County Zoning Committee, having held a public hearing on February 20, 2009, pursuant to Section 59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petition described as follows be approved, and shall take effect upon approval by the Sawyer County Board of Supervisors.

Create: SECTION 14 SAWYER COUNTY ZONING COMMITTEE

 

14.1 Any person who alleges that there is an error in any order, requirement or decision made in the enforcement of this ordinance may appeal to the Sawyer County Zoning Committee. Any appeal shall be made on forms furnished by the Zoning Department within 30 days of that administrative action. Other substantiating evidence will be accepted.

 

14.2 Wisconsin Fund Appeals

(1) Request for initial review of determination. Pursuant to Wisconsin State Statute 68.08, any person in disagreement with the denial of a Wisconsin Fund application may have written or oral determination reviewed by written request mailed or delivered to the Zoning Office within 30 days of notice to such person of such determination. The request for review shall state the ground or grounds upon which the aggrieved contends that the decision should be modified or reversed. A request for review shall be made to the Zoning Department.

(2) Appellate Review. Pursuant to Wisconsin State Statute 68.11, an appellate review of the initial determination shall be made to the Sawyer County Zoning Committee pursuant to Section 5.0 APPLICATIONS AND PROCEDURES, Sawyer County Zoning Committee – Rules and By-laws.

 

Motion by Mizerka, 2nd by Zietlow, to approve the Zoning Committee recommendation.  Motion carried.

 

Zoning Department Administrator William Christman presented the Zoning Committee recommendation to approve the following proposed text amendments to the rules and by-laws of the Sawyer County Zoning Committee:

Motion by Vitcenda, 2nd by Johnson, to approve the Zoning Committee recommendation.  Motion carried.

 

Economic Development and Planning Committee Chair Shirley Riedmann presented the Committee’s recommendation to approve the proposed project sponsor’s agreement for the Winter Depot project through the Wisconsin Department of Transportation Division of Transportation System Development Transportation Enhancements Program.  The project includes the restoration of the existing 1905 Winter railroad depot to house a historical display of early railroading, logging, and settlers in the Winter community.  The office of the Winter Area Chamber of Commerce welcome center would also be housed in the depot.  The proposed sponsor’s agreement outlines the sponsor’s responsibilities in relation to the project.  A letter from the Friends of the Tuscobia, dated April 16, 2008, summarizes the responsibilities being assumed by the Friends of the Tuscobia Trail in relation to the project.  Friends of the Tuscobia President Ron Petit presented information about the status of the Winter Depot project and presented the financial and insurance information provided by the Friends of the Tuscobia.  At the March 6, 2009 Economic Development and Planning Committee meeting Wisconsin Department of Transportation Northwest Region Local Project Manager William Zimmer explained that he would provide oversight for the design and construction of the project.  Motion by Zietlow, 2nd by Bassett, to approve the Economic Development and Planning Committee recommendation to approve the Winter Depot project sponsor’s agreement.  Motion carried.

 

Forestry Committee Chair James Bassett presented the recommendation of the Forestry Committee to approve the following resolution:

RESOLUTION #2-2009

RESOLUTION FOR OUTDOOR RECREATION AIDS

     WHEREAS, Sawyer County is interested in acquiring or developing lands for public outdoor recreation purposes as described in the applications; and

     WHEREAS, financial aid is required to carry out the project;

     THEREFORE, BE IT RESOLVED, that Sawyer County has budgeted a sum sufficient to complete the project or acquisition and

     HEREBY AUTHORIZES the Sawyer County Forest Administrator or his designee to act on behalf of Sawyer County to:

              ●      Submit an application to the State of Wisconsin Department of Natural Resources for                        any financial aid that may be available;

              ●      Sign documents; and

              ●      Take necessary action to undertake, direct and complete the approved project.

     BE IT FURTHER RESOLVED that Sawyer County will comply with state or federal rules for the programs to the general public during reasonable hours consistent with the type of facility; and will obtain from the State of Wisconsin Department of Natural Resources or the National Park Service approval in writing before any change is made in the use of the project site.

 

IMPORTANT NOTE:  The DNR expects the individual authorized by this resolution to become familiar with the applicable grant program's procedures for the purpose of taking the necessary actions to undertake, direct and complete the approved project.  This includes acting as the primary contact for the project, submitting required materials for a complete grant application, carrying out the acquisition or development project (eg., obtaining required permits, noticing, bidding, following acquisition guidelines, etc.) , and closing the grant project (eg., submitting grant reimbursement forms and documentation, and organization of project files for future monitoring of compliance with grant program).

 

Motion by Vitcenda, 2nd by Olson, to approve the recommendation.  Motion carried.

 

Forestry Committee Chair James Bassett presented the Committee’s recommendation to approve assigning ordinance numbers to the County Owned Land Ordinance, the Firewood Permit Ordinance, and the Recreational Sign Ordinance.  These ordinances were part of the 15 Year Plan of the Sawyer County Forest approved by the Sawyer County Board October 20, 2005.  Ordinance numbers are necessary for the issuance of citations for violations of the ordinances.  Motion by McCoy, 2nd by Johnson, to table consideration of the recommendation until completion of the Sawyer County Forest Access Management Plan and to allow for the correction of typographical errors in the ordinances.  Motion carried.  Mr. Zietlow voted no.

 

Land and Water Conservation Department Director Dale Olson presented the Land and Water Conservation Committee recommendation to approve the following resolution:

RESOLUTION #3-2009

IN SUPPORT OF RESTORING THE WILDLIFE DAMAGE AND ABATEMENT PROGRAM

WHEREAS, the agricultural producers of Sawyer County are facing economic hardship; and

WHEREAS, agricultural land is important for the diversity, natural beauty, and traditions of Sawyer County; and

WHEREAS, the size and diversified landscape of the County make it an ideal habitat for wildlife; and

WHEREAS, Sawyer County is consistently one of the areas impacted the most heavily by depredation of crops due to deer, bears, turkeys, and geese; and

WHEREAS, the County, through the Department of Natural Resources Wildlife Damage and Abatement Program has historically assuaged crop losses through both abatement and compensation; and

WHEREAS, the Wildlife Damage and Abatement program will not be able to fund agricultural producers at the current level due to use of the fund for the Chronic Wasting Disease (CWD) program; and

WHEREAS, the program currently requires agricultural producers to achieve a harvest objective of 80% of the species causing damage by September 15th of each year.  This date encourages spoilage of harvested animals and creates a problem for producers attempting to find willing participants to hunt in a “non-traditional” time period.

NOW, THEREFORE, BE IT RESOLVED that the Sawyer County Board of Supervisors opposes lowering the payment cap to $10,000; and

BE IT FURTHER RESOLVED that the Sawyer County Board of Supervisors opposes increasing the program deductible from $250.00 to $500.00.

BE IT FURTHER RESOLVED that the Sawyer County Board of Supervisors supports a change in the deadline for completion of harvest objectives for deer abatement from September 15th to October 15th.

 

Motion by McCoy, 2nd by Maki, to approve the recommendation.  Motion carried.

 

Public Safety Committee Chair Robert Vitcenda presented the Committee’s recommendation that the County Board make a recommendation to the Sawyer County judicial system to penalize those convicted of operating while intoxicated (OWI) and related alcohol and drug offenses according to the high end of the penalty range for those offenses, rather than the minimums as listed in the summary of OWI and Related Alcohol and Drug Penalties (as of 2007 Act 226; May 30, 2008).  Motion by Bassett, 2nd by Maki, to approve the recommendation.  Motion carried.

 

Health and Human Services Department Director Pete Sanders presented the Health and Human Services Board recommendation to support the application of the Sawyer County and LCO Youth Prevention Programming Coalition for a State of Wisconsin Strategic Planning Framework Incentive Grant.  Funds received from the grant would be used to address alcohol related motor vehicle fatalities and injuries for individuals between the ages of 16 and 34.  Motion by Bassett, 2nd by Kinsley, to approve support for the grant application.  Motion carried.

 

Finance Committee Chair Kathy McCoy presented the Committee’s recommendation to approve a proposed authorization form for an electronic funds transfer account for the funds to be collected by LifeQuest for services provided by the Sawyer County Ambulance Service.  Motion by Riedmann, 2nd by Vitcenda, to approve the recommendation.  Motion carried.

 

The Board discussed the concerns of the Property and Airport Committee and Maintenance Department Supervisor Dennis Erickson with issues presented when departments hire, direct, or perform alterations on County facilities without the notification or the approval of the Property and Airport Committee or the Maintenance Department.  The Property and Airport Committee, at their meeting held March 9, 2009, discussed the development of a policy requiring the notification or the approval of the Property and Airport Committee or the Maintenance Department for alterations to be performed on County facilities, with the exception of Highway Department facilities and the installation of computer and telephone wiring or equipment by the Information Technology Department.  The Board discussed whether additional exceptions should be included in the policy and had other questions concerning the wording of the policy.  Motion by Bassett, 2nd by Zietlow, to refer the matter back to the Property and Airport Committee to develop a recommendation for the wording of the policy.  Motion carried. 

 

Health and Human Services Department Director Pete Sanders and Human Resource Manager Carol Larson presented the Health and Human Services Board and the Personnel and Administrative Committee recommendation to approve a side letter of agreement with the Professional Employee Bargaining Unit to continue 40-hour work weeks in Long Term Care until the implementation of Family Care.  Motion by Bassett, 2nd by Schleeter, to approve the recommendation.  Motion carried.

 

Human Resource Manager Carol Larson presented the Highway Committee recommendation to authorize the hiring of summer employees for the Highway Department.  The Board reviewed a comparison of costs prepared by Highway Commissioner Gary Gedart for the following options:

  $23,601.00 - 6 college students

  $26,783.94 – 4 college students and 2 prisoners from Flambeau Correctional Center

  $16,415.00 – 4 college students

  $15,023.31 – no college students and 6 prisoners from Flambeau Correctional Center

The Personnel and Administrative Committee, at their meeting held March 17, 2009, reviewed the options and recommends authorization for the Highway Department to:

·         Use prisoners until 4 college students are hired and begin summer employment with the Highway Department.

·         Hire 2 skilled employees for summer employment with the Highway Department.

Motion by Vitcenda, 2nd by Olson, to approve the Personnel and Administrative Committee recommendation.  Motion carried.

 

Human Resource Manager Carol Larson presented the Forestry Committee and the Personnel and Administrative Committee recommendation to authorize the hiring of a limited-term (less than 600 hours) employee in the Forestry Department to update Sawyer County Forest reconnaissance information.  The position (wages, benefits, mileage, and equipment) will be funded 100% from a sustainable forestry grant.  Motion by Bassett, 2nd by Mizerka, to approve the recommendation.  Motion carried.

 

Human Resource Manager Carol Larson presented the Land and Water Conservation Committee and the Personnel and Administrative Committee recommendation to authorize the hiring of a 2009 summer intern for park and dam maintenance (480 hours @ $12 per hour - $4,000 levied/$2,000 grant funded) and of a part-time intern for aquatic invasive species control (240 hours 100% grant funded) for the Land and Water Conservation Department.  Land and Water Conservation Department Director Dale Olson had reported to the Personnel and Administrative Committee that the summer interns hired by the Land and Water Conservation Department have assisted and will continue to assist the Zoning Department with shoreland inspections.  Motion by Vitcenda, 2nd by Johnson, to approve the recommendation.  Motion carried.

 

County Board Chair Hal Helwig announced that the Burnett County Board Chair and County Administrator will attend the April 21, 2009 Sawyer County Board meeting (beginning at 6:00 p.m.) to present information concerning Burnett County Board meetings, processes, and organization.   

 

Land and Water Conservation Committee and Zoning Committee Chair James Bassett reported that the Wisconsin Department of Natural Resources approved final flood plain elevation maps for the Round Lake and Lac Courte Oreilles watershed.
