Minutes of the meeting of the Sawyer County Board of Supervisors

Chairman Hal Helwig called the March meeting of the Sawyer County Board of Supervisors to order.  Roll call was as follows:

Motion by Kinsley, 2nd by Vitcenda, to convene into closed session, pursuant to section 19.85(1)(g), Wisconsin Statutes, for the purpose of discussing the Hausman vs. Sawyer County (Round Lake water level) litigation.  Motion carried by unanimous voice vote.

[Minutes of closed sessions are kept in a confidential file in the County Clerk’s Office.]

Motion by Miller, 2nd by Kinsley, to reconvene into open session.  Motion carried.

 

The agenda for the meeting was presented as follows:

Motion by Suhsen, 2nd by Kinsley, to approve the meeting agenda as presented.  Motion carried.

 

Motion by Suhsen, 2nd by Miller, to approve the minutes of the meeting of February 17, 2005.  Motion carried.

 

Zoning Administrator William Christman presented the following report of the Zoning Committee:

 

The Sawyer County Zoning Committee, having held a public hearing on February 18, 2005, pursuant to Section 59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petitions described as follows be approved:

 

TOWN OF BASS LAKE

1) Gayle Naegeli. Lots 1-4 and Lot 42, Block 1, 2nd Addition Abendpost Beach, S 31, T 40N, R 8W, Parcel -14.1.1. #326062. 0.529 acres total. Change from District Forestry One to District Residential/Recreational One. Purpose of request is to operate a beauty salon within an existing structure. Said property does not meet the dimensional requirements of the Forestry One zone district. Also application for Conditional Use. The Town Board has approved.  The Zoning Committee approved the application, with the conditional use approval for Naegeli only. Findings of Fact: It would not be damaging to the rights of others or property values. It would be compatible with surrounding uses and the area. It would be in compliance with the Town Board long-range plan.

 

Motion by Suhsen, 2nd by Miller, to approve the recommendation.  Motion carried.

 

The Board reviewed the recommendation of the Zoning Committee to approve the following resolution:

RESOLUTION #6-2005

AMENDING SAWYER COUNTY ZONE DISTRICT MAPS

     WHEREAS, the Sawyer County Board of Supervisors has heretofore been petitioned to amend the Sawyer County Zone District Maps; and

     WHEREAS, the petitions have been referred to the Sawyer County Zoning Committee for public hearings; and

     WHEREAS, the Zoning Committee, on due notice, conducted a public hearing on the proposed amendments and filed their recommendations with the Board; and

     WHEREAS, this Board has the legal authority to amend zone districts pursuant to Section 59.69 (5) (e), Wisconsin Statutes.

     NOW, THEREFORE BE IT RESOLVED, that the Sawyer County Zone District Maps, adopted March 1, 1971, be and the same are hereby amended as follows:

TOWN OF BASS LAKE

1) Gayle Naegeli. Lots 1-4 and Lot 42, Block 1, 2nd Addition Abendpost Beach, S 31, T 40N, R 8W, Parcel -14.1.1. #326062. 0.529 acres total. Change from District F-1 to District RR-1.

 

Motion by Vitcenda, 2nd by Kinsley, to approve RESOLUTION #6-2005.  Motion carried.

The Board reviewed the recommendation of the Zoning Committee to approve the following resolution:

RESOLUTION #7-2005

AMENDING THE SAWYER COUNTY ZONING ORDINANCE

     WHEREAS, Sawyer County has adopted and is enforcing the Sawyer County Zoning Ordinance, Sawyer County Subdivision Control Ordinance, and the Sawyer County Citation Ordinance;

     WHEREAS, these amendments were drafted to promote and protect the public’s health, safety, and general welfare and to clarify other sections of the ordinance in the best interest of Sawyer County residents; and

     WHEREAS, the Zoning Committee on due notice conducted a public hearing on the proposed text amendments and filed their recommendations with the Board; and

     WHEREAS, this Board has the legal authority to amend Sawyer County ordinances pursuant to Section 59.69 (5) (e), Wisconsin Statutes.

     NOW, THEREFORE BE IT RESOLVED, that the following amendments to the Sawyer County Zoning Ordinance are hereby adopted and shall take effect upon its passage by the Sawyer County Board of Supervisors.

Re:  Public Hearing held February 18, 2005

 

PROPOSED TEXT AMENDMENTS TO THE SAWYER COUNTY ZONING ORDINANCE – as above

 

Motion by Miller, 2nd by Vitcenda, to approve RESOLUTION #7-2005.  Motion carried.

 

County Board Chairman Hal Helwig presented his recommendation to appoint Town of Winter resident Darwin Hintz (N2976 West Lane, Winter, Wisconsin 54896) to the Sawyer County Zoning Board of Appeals for the term of one year beginning April 1, 2005.  Motion by Suhsen, 2nd by Vitcenda, to approve the recommendation.  Motion carried.  Mr. Bassett voted no.

 

The Board reviewed the Economic Development and Planning Committee recommendation to approve Northwest Regional Planning Commission’s proposal to provide Sawyer County with pre-planning services for the development of a comprehensive plan for Sawyer County with an estimated cost of $13,000 and an additional $2,000 to prepare a comprehensive planning grant application.  Motion by Miller, 2nd by McCoy, to approve the recommendation.  Motion carried.

 

Motion by Miller, 2nd by Mizerka, to refer to the Finance Committee discussion of where the funds should come from to pay for the pre-planning services for the development of a comprehensive plan for Sawyer County.  Motion carried.

 

Sawyer County University of Wisconsin-Extension Department 4-H Youth Development Educator Lori Laberee and Winter High School student Kirk Olson presented a report on the 2005 “Superior Days” events held in Madison during the month of February.  Ms. Larebee, Mr. Olson, and Town of Draper resident Brenda Adler participated in the events as the representatives of Sawyer County.  Motion by Miller, 2nd by Kinsley, to commend Mr. Olson, Ms. Adler, and Ms. Laberee for their efforts in representing Sawyer County at the “Superior Days” events.  Motion carried by unanimous voice vote.

 

The Forestry Committee presented their recommendation for approval of the 2005 Emergency Fire Warden Organization List for Sawyer County.  Motion by Suhsen, 2nd by Miller, to approve the recommendation.  Motion carried.  Mr. Bassett abstained.

 

The Board reviewed a pre-audit report on 2004 Sawyer County General Fund expenditures and revenues and other County fund balances prepared by the County Clerk’s Office.  The report indicated a preliminary total 2004 General Fund balance of $1,057,497.41 ($120,660.33 less expenditures than budgeted and $936,837.08 more revenues than forecast).  Motion by Miller, 2nd by Vitcenda, to accept the report.  Motion carried.

 

The Board reviewed the Personnel and Administrative Committee recommendation to approve a proposal for a public records notice and policy for the County, including an updated schedule of fees for copies requested by the public.  Motion by Miller, 2nd by Riedmann, to approve the recommendation.  Motion carried.

 

The Board reviewed the Personnel and Administrative Committee recommendation to retain Sawyer County Corporation Counsel Thomas J. Duffy as Sawyer County’s Corporation Counsel, and that the compensation for corporation counsel services be increased to $100 per hour, effective April 1, 2005.  Motion by Miller, 2nd by Riedmann, to approve the recommendation.  Motion carried.

 

County Board Chairman Hal Helwig presented his recommendation to appoint Robert Vitcenda to replace Frank Romnes on the Agriculture and Extension Education, Forestry, and Land and Water Conservation Committees.  Motion by Miller, 2nd by Kinsley, to approve the recommendation.  Motion carried.

 

Motion by Miller, 2nd by Vitcenda, to adjourn the meeting.  Motion carried.
