Chairman Hal Helwig called the January meeting of the Sawyer County Board of Supervisors to order.  Roll call was as follows:

The meeting agenda was presented as follows:

09.    Closed session, pursuant to section 19.85(1)(e), Wisconsin Statutes, to discuss negotiations for an agreement for legal services.

The Board may reconvene into open session to announce or take action on matters discussed in closed session.

 

Motion by Bassett, 2nd by Kinsley, to approve the meeting agenda as presented.  Motion carried.

 

Motion by Olson, 2nd by McCoy, to approve the minutes of the meeting of December 15, 2005 (amended to indicate that the Library has a right of first refusal to repurchase the property from the County at no more than the $250,000 paid by the County).  Motion carried.

 

 Zoning Administrator William Christman presented the following report of the Zoning Committee:

The Sawyer County Zoning Committee, having held a public hearing on December 16, 2006, pursuant to Section 59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petitions described as follows be approved:

 

TOWN OF HUNTER

1) David H. Egge. Part of the NW¼ NW¼, S 3, T 40N, R 7W; Part of Parcel .6.1. Doc #333002. 350’x700’ containing approximately 5.64 acres out of the total 41.57 acres. Change from District Residential/Recreational One to District Commercial One. Purpose of request is to sell a commercial lot, returning to the zone district that existed on the property in the year 2000. The Town Board has approved. Findings of Fact: It would not be damaging to the rights of others or property values. It would be compatible with surrounding uses and the area.

 

Motion by Kinsley, 2nd by Olson, to approve the Zoning Committee recommendation.  Motion carried.  Mr. Miller voted no.

 

TOWN OF METEOR

2) Harold P. Skogstad Sr. et ux. Part of the SW¼ NW¼, S 13, T 37N, R 8W; Part of Parcel .7.1. Vol 631 Records Page 291. Approximately 780’x450’ and 395’x450’ out of the total 12.64 acres. The remainder is to stay Commercial One. Change from District Commercial One to District Residential/Recreational One. Purpose of request is to conform with the existing residential use on those portions of the property. No financing of Commercial property that is not being used for commercial purposes. The Town Board has approved. Findings of Fact: It would not be damaging to the rights of others or property values. It would be compatible with the surrounding uses and the area. It would not create an objectionable view.

 

Motion by Suhsen, 2nd by Voight, to approve the Zoning Committee recommendation.  Motion carried.

 

Zoning Administrator William Christman presented the following report of the Zoning Committee:

The Sawyer County Zoning Committee, having held a public hearing on October 21, 2006, pursuant to Section 59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petition described as follows be denied. The Committee further recommends that a new change of zone district application be applied for, fee waived.

TOWN OF LENROOT

1) Daniel W. Krause et ux. Lot 2, being Part of the NE¼ SW¼, S 11, T 42N, R 8W, Parcel 3101. Vol 832 Records Page 455; CSM Vol 16 Page 22. 7.25 acres total. Change from District Residential/Recreational One to District Agricultural Two. Purpose of request is to raise a market garden and small animals. The Town Board has tabled from the September Public Hearing. Findings of Fact:  It would not be compatible with surrounding uses and the area. No one to represent.

 

Motion by McCoy, 2nd by Miller, to approve the Zoning Committee recommendations, and that the waiting period  and fees for reapplication are waived.  Motion carried.

 

Zoning Administrator William Christman presented the Zoning Committee recommendation to approve:

AMENDING SAWYER COUNTY ZONE DISTRICT MAPS

     WHEREAS, the Sawyer County Board of Supervisors has heretofore been petitioned to amend the Sawyer County Zone District Maps; and

     WHEREAS, the petitions have been referred to the Sawyer County Zoning Committee for public hearings; and

     WHEREAS, the Zoning Committee, on due notice, conducted a public hearing on the proposed amendments and filed their recommendations with the Board; and

     WHEREAS, this Board has the legal authority to amend zone districts pursuant to Section 59.69 (5) (e), Wisconsin Statutes.

     NOW, THEREFORE BE IT RESOLVED, that the Sawyer County Zone District Maps, adopted March 1, 1971, be and the same are hereby amended as follows:

TOWN OF HUNTER

Zoning Administrator William Christman presented the Board of Appeals recommendation to amend section 5.12 of the Sawyer County Board of Appeals Rules and By-laws as follows:

5.12 Fees

The applicant/appellant shall pay such fees as may be from time to time established by the County Board, which amount shall be deposited with the Zoning Administrator for each application/appeal filed before a public hearing will be scheduled.  Any fees required for the copying of, reproduction of or the publishing of documents, photographs, or the copying of recorded tapes or the copying or reproduction of any item related to the “record” created by a decision of the Sawyer County Zoning Committee shall be the responsibility of the appellant and shall be paid to the Zoning Administrator prior to the Board conducting a public hearing on the appeal.  The Zoning Administrator shall provide an itemized bill to the appellant for payment.  Any services required of an outside agency shall be at the discretion of the Zoning Administrator and shall be billed to the appellant accordingly.  At the request of the appellant and at his/her expense, a single copy of the “record’s” documentation may be provided by the Zoning Administrator to the appellant, who shall then make the required number of copies for submission to the Board.

Motion by Suhsen, 2nd by Bassett, to approve the recommendation.  Motion carried.

 

Motion by Bassett, 2nd by Mizerka, to have February 4, 2006 as the effective date for the above amendments to section 5.10 of the Sawyer County Zoning Committee Rules and By-laws, and to section 5.12 of the Sawyer County Board of Appeals Rules and By-laws.  Motion carried.

 

Forestry Committee Vice-Chairman William Voight presented the Sawyer County Forest work plan for the calendar year 2006 and the recommendation of the Forestry Committee to approve the plan.  Motion by Suhsen, 2nd by Miller, to approve the recommendation.  Motion carried.

 

The Board reviewed correspondence received from Aegis Corporation (administrators for the Wisconsin County Mutual Insurance Corporation) regarding an endorsement to the County’s public entity liability insurance policy providing limited coverage for legal expenses for matters which are not otherwise provided coverage under the County’s policy.  To qualify for the endorsement counties are required to approve a resolution requesting the legal expense coverage and authorizing a designee(s) to request coverage under the legal expense endorsement.  Courthouse Committee Chairman Bruce Miller presented the Committee’s recommendation to approve the following resolution:

RESOLUTION #2-2006

LEGAL EXPENSE COVERAGE – WISCONSIN COUNTY MUTUAL INSURANCE CORPORATION

     WHEREAS, the Wisconsin County Mutual Insurance Corporation offers to provide legal expense coverage for matters for which coverage is not otherwise available under the liability policy;

     NOW, THEREFORE, BE IT RESOLVED, that the Sawyer County Board of Supervisors does hereby authorize the request for coverage under the legal expense endorsement, per the endorsement form number WCMIC – End 23 (10/24), from the Wisconsin County Mutual Insurance Corporation to be requested as needed by the County Board Chair or otherwise authorized designee.

     BE IT FURTHER RESOLVED that the County Board of Supervisors is designating the following individuals to be the authorized designees for requesting coverage under the legal expense endorsement:  Sawyer County Clerk Kris Mayberry and Sawyer County Board Chairman Hal Helwig.

 

Motion by Miller, 2nd by Kinsley, to approve the recommendation.  Motion carried.

 

District 15 Sawyer County Supervisor William Voight and Winter area resident Lynn Passow presented information and a request for $40,000 from the County towards the total $86,435.37 cost to construct restroom facilities at Doc Smith Park in the Village of Winter.  The Village will receive a $32,556.44 grant from the Wisconsin Department of Natural Resources towards the cost of the project.  The Board discussed whether a policy could be developed to address requests for County contributions to municipal projects.  Motion by Kinsley, 2nd by Miller, to authorize establishing a committee to explore developing such a policy with the committee to be made up of members of the Finance Committee and the Conservation Committees.  Motion carried.

 

The Board reviewed a request from Douglas County Board Chairman Douglas Finn for a contribution of $1,000 towards the estimated $30,000 cost of staging the Superior Days XXI event to be held in Madison February 28 to March 1, 2006.  Motion by Voight, 2nd by Miller, to approve the Finance Committee recommendation to approve the request.  Motion carried.

 

County Clerk Kris Mayberry presented information about the financial aspects for the County of the Statewide Voter Registration System (SVRS), including the County’s use of KD Consulting (Ken Hebbe) for technical support for SVRS functions and a proposal for the County to assist municipalities that are not relying on Sawyer County for the SVRS application, as well as those that are, with technical support and equipment.  Motion by Miller, 2nd by Bassett, to approve the Finance Committee recommendation to approve the proposal.  Motion carried.

 

The Board reviewed information prepared by Land Records Department Director Robyn Thake about the collaborative aerial photography and digital orthophotography project planned for 2006 with member counties of the N & W Wisconsin Orthophotography Consortium.  The 2006 Sawyer County Budget includes $50,000 of the $100,000 required as the Sawyer County contribution towards the project.  In order to proceed with the project the Consortium requires each member county to commit to their full contribution to the project prior to January 31, 2006.  Motion by Miller, 2nd by McCoy, to approve the Finance Committee recommendation to commit the full $100,000 Sawyer County contribution for the project.  Motion carried by unanimous voice vote.

 

County Clerk Kris Mayberry reported that a meeting of interested parties is scheduled for Thursday, January 26, 2006, from 9:00 a.m. until noon, at Famous Dave’s Restaurant, for discussion of Sawyer County’s petition to the Wisconsin Department of Natural Resources seeking review and clarification of certain orders relating to Round Lake, Little Round Lake, and Osprey Lake.  Pursuant to an agreement between Sawyer County and the Wisconsin County Mutual Insurance Corporation (WCMIC), WCMIC will provide Sawyer County with legal representation in those discussions by retaining the Weld, Riley, Prenn & Ricci law firm (Attorney Scott Cox).  Motion by Suhsen, 2nd by Miller, to approve the agreement.  Motion carried.

 

County Clerk Kris Mayberry reported that the Northwest ITBEC (International Trade, Business & Economic Development Council) is meeting at LCO in Sawyer County on February 14, 2006, beginning at 10:00 a.m.  It is anticipated that the morning session will include mostly routine ITBEC business and that the afternoon session is likely to include a discussion of the Northwest ITBEC’s purpose and direction. 

 

County Board Chairman Hal Helwig reported that Sawyer County had received a check in the amount of $11,738 from the Wisconsin County Mutual Insurance Corporation representing Sawyer County’s liability insurance policy dividend for the 2004 policy year.
