PUBLIC HEARING BEFORE THE

SAWYER COUNTY BOARD OF APPEALS

21 FEBRUARY 2006

PRELIMINARY MATTERS

1)      Call to Order and Roll Call

RZ calls the Public Hearing before the Sawyer County Zoning Board of Appeals to order at 7:00 P.M. in the Sawyer County Courthouse, 10610 Main St., Hayward, Wisconsin. Roll is called finding present: RZ, KZ, HB, LR, AG, WAC, and CY. Also Mike Kelsey, BOA attorney.

2)      Statement of Board and Hearing Procedures.

Those wishing to speak will be afforded the opportunity provided they identify themselves. RZ gives order of submitting files to BOA, taking testimony, and making a decision. Requests orderly procedure. Gives appeal deadline.

3)      Statement of Hearing Notice.

Public Hearing published as a Class 2 Notice in accordance with Chapter 985 of the Wisconsin Statutes in the Sawyer County Record on February 1 and 8, 2006.

 

VARIANCE APPLICATIONS

1)  Town of Meteor – Ramsey G. Anderson et ux. 06-002. The E ½ of the SE ¼ NE ¼ , S 13, T 37N, R 8W, Parcel .4.2. Vol 549 Records Page 130. 19.97 acres total. Property is zoned Agricultural One. Application is for the installation of a second driveway access onto State Highway 48 at a setback distance of 467’ to the nearest driveway. Variance is requested as Section 4.23(1), Sawyer County Zoning Ordinance, would require a minimum setback distance of 500’ between driveways accessing this highway and Section 4.23(2) would allow only a single driveway access to this property. The Town Board has approved the application contingent upon Highway Department approval.

 

WAC reads application into the record; presents tax listers map, zone district map, and wetland map. Presents photos. Seven (7) letters were sent. 3 were returned with no objections; 1 with objections. JoAnn Anderson present, needs driveway for a horse show barn. Problem with getting hay wagons into the property. No visibility problems according to state when they were on site. No other access available into that portion of the property. State and Town Board have no problem with the location. No campers/trailers will be allowed. It is the most feasible place. AG familiar with the site, there is a kind of natural intersection already, no visibility problem.

AG motions to approve the application.

LR seconds motion.

Unanimous vote.

Findings of Fact: There would be no change in use in the zone district. It would not be damaging to the rights of others or property values. It would be a practical solution to an easy problem.

2)  Town of Round Lake - William S. Nielsen et ux. #06-002. Lot 52, Big Wolf Island Subdivision, S 19, T 41N, R 5W, Parcel -1.52. Doc #312759. .59 acres total. Property is zoned Recreational/Residential One. Application is for the construction of a 60’x40’ (62’x42’ with eaves) storage building for personal use on a vacant lot. The building cannot be constructed on the lot (lot #8) that contains the applicant’s dwelling. Variance is requested as Section 4.26, Sawyer County Zoning Ordinance, would prohibit the construction of this building on a vacant lot. The Town Board has approved.

 

WAC reads application into the record; presents tax listers map, zone district map, and wetland map. Town Board: side walls not to exceed 10’. Twenty (20) letters sent out. 8 returned with no objection; 6 with objection. Application is for storage building on vacant lot. Building can’t fit on lot with home. Proposed size is 62’x42’ with eaves. Nielsen present, pass out map of area. The residence is on Lot 8, not enough room to build shed. Goal is to place shed as far back from road as possible. Will put in a curved driveway. Has a couple boats, truck, and would like to purchase a pontoon. Eyesore with these items sitting out around home. Also has a photo of lot home is on and the location of proposed shed. Town Board approved with limit of 10’ side walls. Lot 52 is better suited with better terrain. RZ was on site, lot with home has no room for shed. 2 car garage exists. Lot 53 has bad terrain, rises straight up. However, 62’x42’ is excessive. Size of building doesn’t fit the property. Too large for zone district. AG also feels 40x60 doesn’t fit in with that area. Nieghbors would be more supportive if smaller size. Suggests downsizing, but not sure what that size would be. Nielsen: Would have earth tone color, metal siding, would hook up electric, not heated. Discussion of size. Nielsen suggests 32’x40’. BOA more receptive to that figure. HB questions if this is setting a precedent. Have there been other variances for garages like this. Discussion of past variances.

RZ motions to approve the application as amended: Size 32’x40’ (34’x44’ with eaves), no higher than 10’ side walls; 2 year time limit.

KZ seconds motion.

Unanimous vote.

Findings of Fact:  There would be no change in use in the zone district. It would not be damaging to the rights of others or property values. There is no room on the property that the home sits on.

 

PROPOSED TEXT AMENDMENT - BOARD OF APPEALS RULES AND BY-LAWS

Page 7 - 5.12 Fees

As previously discussed, zoning administration wants to delete last sentence: “At the request of the appellant and at his/her expense, a single copy of the “record’s” documentation may be provided by the Zoning Administrator to the appellant, who shall then make the required number of copies for submission to the Board.” Zoning to provide all copies at appellant’s expense.

AG motions to approve amendment.
