Motion by Miller, 2nd by Vitcenda, to approve the meeting agenda as presented.  Motion carried.

 

Motion by Bassett, 2nd by Vitcenda, to approve the December 21, 2006 meeting minutes.  Motion carried.

 

Zoning Administrator William Christman presented the following Zoning Committee report:

The Sawyer County Zoning Committee, having held a public hearing on December 15, 2006, pursuant to Section 59.69 (5) (e), Wisconsin Statutes, notice thereof having been given as provided by law and being duly informed of the facts pertinent to the proposed changes, hereby recommends that the petitions described as follows be approved:

 

TOWN OF BASS LAKE

1) Jeffrey L. Jones. Part of the SE1/4 SW1/4, S 6, T 39N, R 9W, Parcel .12.1. Vol 838 Records Page 513. 39 acres. Change from District Agricultural One to District Agricultural Two. Purpose of request is for the creation of a 10 acre lot for sale to a purchaser not engaging in agricultural activities. Also for the possible creation of other residential lots at least 5 acres in size. The Town Board has approved. Findings of Fact: It would not be detrimental to ecology, wildlife, wetlands or shorelands. It would be compatible with the surrounding uses and the area.

 

Motion by Miller, 2nd by Vitcenda, to approve the Zoning Committee recommendation.  Motion carried.

 

TOWN OF HAYWARD

2)  Gary Haus. Lot 2, being Part of Govt Lot 1, S 1, T 39N, R 8W, Parcel :1.7. Doc #321899; USA in Trust Transaction #431-10-11095-05; CSM Vol 28 Page 338. 1.08 total acres. Change from District Forestry One to District Residential/Recreational One. Purpose of request is for the construction of a dwelling by the purchaser. The Town Board has approved the application. Findings of Fact: It would not be damaging to the rights of others or property values. It would be compatible with the surrounding uses and the area.

 

Motion by Mizerka, 2nd by McCoy, to approve the Zoning Committee recommendation.  Motion carried.

 

Zoning Administrator William Christman presented the Zoning Committee recommendation to approve the following resolution:

RESOLUTION #1-2007

AMENDING SAWYER COUNTY ZONE DISTRICT MAPS

     WHEREAS, the Sawyer County Board of Supervisors has heretofore been petitioned to amend the Sawyer County Zone District Maps; and

     WHEREAS, the petitions have been referred to the Sawyer County Zoning Committee for public hearings; and

     WHEREAS, the Zoning Committee, on due notice, conducted a public hearing on the proposed amendments and filed their recommendations with the Board; and

     WHEREAS, this Board has the legal authority to amend zone districts pursuant to Section 59.69 (5) (e), Wisconsin Statutes.

     NOW, THEREFORE BE IT RESOLVED, that the Sawyer County Zone District Maps, adopted March 1, 1971, be and the same are hereby amended as follows:

TOWN OF BASS LAKE

Motion by Kinsley, 2nd by Mizerka, to approve RESOLUTION #1-2007.  Motion carried.

 

Zoning Administrator William Christman presented the Zoning Committee recommendation to approve amendments to the text of portions of Section 4.25 of the Sawyer County Zoning Ordinance pertaining to the creation of lots.  Zoning Committee member Fred Zietlow requested that the proposed amendments be referred back to the Zoning Committee for further discussion.  Motion by Miller, 2nd by Riedmann, to approve the proposed amendments.  Motion carried.

 

Zoning Administrator William Christman presented the Zoning Committee recommendation to approve the following resolution:

RESOLUTION #2-2007

AMENDING THE SAWYER COUNTY ZONING ORDINANCE

     WHEREAS, Sawyer County has adopted and is enforcing the Sawyer County Zoning Ordinance, Sawyer County Subdivision Control Ordinance, and the Sawyer County Citation Ordinance;

     WHEREAS, these amendments were drafted to promote and protect the public’s health, safety, and general welfare and to clarify other sections of the ordinance in the best interest of Sawyer County residents; and

     WHEREAS, the Zoning Committee on due notice conducted a public hearing on the proposed text amendments and filed their recommendations with the Board; and

     WHEREAS, this Board has the legal authority to amend Sawyer County ordinances pursuant to Section 59.69 (5) (e), Wisconsin Statutes.

     NOW, THEREFORE BE IT RESOLVED, that the following amendments to the Sawyer County Zoning Ordinance are hereby adopted and shall take effect upon its passage by the Sawyer County Board of Supervisors.

 

AMENDMENTS TO THE SAWYER COUNTY ZONING ORDINANCE

Section 4.25 LOT SIZES

Create 4.251, Creation of Lots

1)  Any LOT created after adoption of this ordinance, or an amendment thereto, shall contain in rectangular form, and extending rearward from the LOT FRONT, the most restrictive minimum LOT AREA, LOT WIDTH and LOT DEPTH requirements contained in either Section 4.417 Lake Class Development Standards or Section 18.0 Dimensional Requirements.

2)  Creation of LOTS in which the LOT DEPTH cannot be met within the first 200 feet.

      a) LOT AREA shall be, at a minimum, 150% of the most restrictive minimum requirements of either Section 4.417 Lake Class Development Standards – (Lot size) or Section 18.2 – (Required Lot Area).

b) A minimum 5,000 square feet of buildable area must be created within the lot and documented by a Certified Survey Map or Plat.

 

Motion by Miller, 2nd by McCoy, to approve RESOLUTION #2-2007.  Motion carried.

 

The Board reviewed the Agriculture and Extension Education Committee and Finance Committee recommendation to approve the transfer of $615.43 from the repair and maintenance line item of the 2006 University of Wisconsin-Extension Department budget to the 2006 Courthouse Maintenance budget towards the expense of the renovations to the University of Wisconsin-Extension Department offices.  Motion by Vitcenda, 2nd by Kinsley, to approve the recommendation.  Motion carried.

 

The Board reviewed the Forestry Committee recommendation to approve accepting the summary report of Solum & Associates adjusting the market value of 280 acres of the real estate to be purchased by Sawyer County from the State of Wisconsin Board of Commissioners of Public Lands.  The adjustment to reduce the purchase price by $27,000 was requested to reflect the reservation required by section 24.11 of the Wisconsin Statutes to be included in the conveyance of the lands from the State to the County reserving to the people the right of access to the navigable waters bordered by such lands.  Motion by Bassett, 2nd by Vitcenda, to approve the recommendation.  Motion carried.

 

The Board reviewed the Forestry Committee and Finance Committee recommendation to approve the expenditure of $3,000 from the Sawyer County Resource Development Fund towards the expense of funding an ATV and Snowmobile Coordinator position for Sawyer County.  Motion by Miller, 2nd by Riedmann, to approve the recommendation.  Motion carried.

 

The Board reviewed the Forestry Committee’s recommendation to approve a 2007 Emergency Fire Warden Organization List in accordance with sections 26.12(3) and 26.14(3) of the Wisconsin Statutes for the prevention and suppression of forest fires in Sawyer County.  Motion by Kinsley, 2nd by McCoy, to approve the recommendation.  Motion carried.  Mr. Bassett abstained from voting because his name is on the list of proposed Fire Wardens.

 

The Board reviewed the Courthouse Committee recommendation to approve proposed consulting agreements for 2007 with Lewis and Associates (Bill Lewis) and KD Consulting (Ken Hebbe).  Motion by Miller, 2nd by Aderman, to approve the recommendation.  Motion carried.

 

Courthouse Committee Chair Bruce Miller presented the following resolution:

RESOLUTION #3-2007

REQUESTING THE STATE OF WISCONSIN

TO BACKFILL CUTS TO THE STATE’S CHILD SUPPORT PROGRAM

     WHEREAS, Wisconsin counties are mandated to administer Child Support Enforcement Programs on behalf of the State and Federal government; and,

     WHEREAS, Federal Aid covers 66% of all administrative costs of the enforcement programs, which means that the Federal Government matches local expenditures at a rate of roughly $2 for every $3 spent; and,

     WHEREAS, the Federal Deficit Reduction Act of 2005, approved by Congress and signed by the President, reduces Child Support Enforcement funding by no longer allowing counties to use Federal Performance Incentive Funding as local match to offset the cost of operating their Child Support Agencies; and,

     WHEREAS, this change goes into effect with the beginning of the Federal Fiscal Year on October 1, 2007; and,

     WHEREAS, the full impact of this change takes place in 2008 when the County would have to either make program cuts to make up for the inability to claim incentive matching funds, or back- fill with local funding to maintain programs at 2007 levels; and,

     WHEREAS, Sawyer County believes it is the State’s responsibility to fully fund its mandated programs, especially if it continues to place local governments under levy limits; and,

     WHEREAS, decreased Federal funding will mean reductions in Child Support Enforcement staff, less Child Support collections made on behalf of single-parent families, and greater reliance on Income Maintenance Programs.

     NOW, THEREFORE, BE IT RESOLVED that the Sawyer County Board of Supervisors duly assembled this 18th day of January, 2007 does hereby request that the Governor place adequate funding in the State Budget in order to backfill the reduction in Federal revenues.

     BE IT FURTHER RESOLVED, that the County Clerk is directed to send a copy of this resolution to the Governor’s Office, Sawyer County’s legislative delegation and to the Wisconsin Counties Association.

 

Motion by Miller, 2nd by Kinsley, to approve RESOLUTION #3-2007.  Motion carried.

 

The Board reviewed a proposed agreement with Cheqtel Communications for providing Sawyer County with upgraded internet access.  Funds for the upgrade were provided in the 2007 Information Technology Department budget.  Motion by Miller, 2nd by Kinsley, to approve the agreement.  Motion carried.

 

Sheriff James Meier presented a letter from the State of Wisconsin Department of Corrections concerning the State’s reimbursement to the County for holding State felony probationer and parolee prisoners in the Sawyer County Jail.  The Sheriff expressed concern that Sawyer County was paid $31.94 per prisoner, which is down from the $36.28 rate paid in the prior year.  Motion by Bassett, 2nd by Vitcenda, to authorize the drafting of a resolution objecting to the amount of State reimbursement for consideration at the February meeting of the County Board.  Motion carried.

 

Sheriff Meier expressed his concern with the lack of an agreement for fire protection in the Town of Ojibwa and the responsibility of the County as the public safety answering point in Sawyer County to respond to emergency situations, including fires.

 

The Board reviewed proposed joint powers agreements with the municipalities in Sawyer County for the Sawyer County 911 emergency system.  Motion by Vitcenda, 2nd by Miller, to approve the agreements and to authorize Sawyer County Clerk Kris Mayberry to sign them on the County’s behalf.  Motion carried.

 

Finance Committee Chair Shirley Riedmann presented the Committee’s recommendation to approve a proposal from KD Telecom for Courthouse telephone system modifications and equipment purchases in the amount of $39,999.70.  Motion by Bassett, 2nd by Aderman, to approve the recommendation.  Motion carried.

 

County Board Chair Hal Helwig presented the following proposed appointments for approval:

  Hayward Library Board representative – Kathy McCoy

  Hayward Library Board representative alternate – Arlene Mizerka

  Northern Waters Library Board representative – Kathy McCoy

  Hayward Lakes Visitor and Convention Bureau representative – Arlene Mizerka

Motion by Miller, 2nd by Kinsley, to approve the appointments.  Motion carried.

 

County Board Chair Hal Helwig presented his recommendation to approve the proposed appointment of Dorothy Mercer and Sheila Obrien to the Sawyer County Housing Authority Board of Directors.  Motion by Mizerka, 2nd by Aderman, to approve the appointments.  Motion carried.

 

County Board Chair Hal Helwig reported that the Sawyer County Sheriff’s Department received verbal approval to open the recently completed addition to the Sawyer County Law Enforcement Center from the State of Wisconsin Department of Corrections and that the Sheriff’s Department was beginning to house prisoners in the addition.  Chair Helwig cited the extraordinary efforts of Sheriff James Meier, Jail Administrator Kurt Barthel, Maintenance Department Supervisor Dennis Erickson, and Sheriff’s Department and Maintenance Department personnel in completing the project and noted the efforts of a transition team (Deputy Joseph Sajdera, Deputy Sonya Sunderland, Deputy Amy Waystedt, and Julie Braatz) which included rewriting the entire jail division policy and procedure manual, developing an instruction manual and information manual for use by the Jailers, rewriting jail and Huber prisoner rules, staff training, purchases, and organization of the new facilities.  Motion by Miller, 2nd by Bassett, to authorize letters of commendation to acknowledge these efforts.  Motion carried by unanimous voice vote.
